FUNDAMENTAL DUTIES - 10mins Seminar Notes


To help promote sprit of patriotism and upload the unity of India.
The prime minister Indira Gandhi with commemoration volumes of the 25th anniversary of the constitution.
It was her government that introduced FUNDAMENTAL DUTIES in 1976.

IMPORTANT FACTS:
  1. Fundamental Duties included in part IV-A.
  2. 42nd amendment act ,1976 during emergency under Indira Gandhi’s government.
  3. Today there are 11 fundamental duties under the article, 51-A. 10 fundamental duties introduced by the 42 amendment
  4. 11th was added by 86th amendment in 2002, during period of Atal Bihari Vajpayee’s govt.
LIST OF FUNDAMENTAL DUTIES:
• To respect national flag and national anthem.
• To our national struggle for freedom.
• To upload and protect the sovereignty, unity and integrity of India.
• To defend the country and render national service.
• To promote harmony and the spirit of common brotherhood => transcending religious, linguistic and regional or sectional diversities.
• To value and preserve the rich heritage =>noblest and richest.
• To protect and improve the natural environment including forests, lakes, rivers and wildlife.
• To develop the scientific temper, humanism and the spirit of inquiry and reform.
• To safeguard public property and to abjure violence.
• To strive towards excellence in all spheres of individual and collective.
• Who parents or guardian to provide opportunities for education to his child=> 6 to 14 years.

UNDER WHAT CIRCUMSTANCES WAS THE 42ND AMENDMENT PASSED:
The government arrested thousands under MISA
(MAINTENANCE OF INTERNAL SECURITY ACT) and carried out anti-poverty programmes.
Apart from adding the 42nd amendment also changed the preamble to the constitution to the included words are “socialist and secular”.
‘SOVEREIGN DEMOCRACTIC REPUBLIC’.

2. VERMA COMMITTEE

SARDAR SWARAN SINGH COMMITTEE
  1. Appointed in 1976
  2. By the congress government under the prime minister Indira Gandhi

NEED FOR COMMITTEE:
“The moral value of fundamental duties would be not to smoother rights but to establish a democratic balance by making the people conscious of their duties equally as they are conscious of rights”.

RECOMMENDATIONS:
  • Inclusion of fundamental duties as a separate part in the constitution.
  • To include the duty to pay taxes.
  • To make fundamental duties justiciable.

VERMA COMMITTEE
  • Appointed by the Human Resource Development ministry, government of India, in 1999.
  • To work out methodology of operationalizing a countrywide programme for teaching fundamental duties.
  • In every education institution as a measure of in-service training.

OBSERVATIONS:
  • Prevention of insults to National Honour Act, 1971.
  • The emblems and names (Prevention of Improper Use) Act, 1950.
  • Flag code of India, available to all states governments and union territory administration.
  • Protection of Civil Rights Act, 1955.
  • Wildlife (protection) Act, 1972.
  • Forest (conservation) Act, 1980.

RECOMMENDATIONS:
  • Duty to vote at elections.
  • Democratic process of governance.
  • Duty of pay taxes should be included in article 51A of the constitution.
